Abstract
This chapter is the sixth section of Kadivar’s ‘Treatise on Refuting the Punishment for Blasphemy and Apostasy’. Many of the early and the most prominent jurists opined that implementing the ḥudūd and calling for jihad are considered to be the exclusive prerogative of the Prophet and the Imams. This chapter categorizes the jurists who are absolutely opposed to implementing the ḥudūd during the occultation to three groups: First, Full Suspension of the ḥudūd during the Imam’s Occultation; second, Discontinuation of the ḥudūd in Cases Leading to Death or Injury during the Occultation; third, Suspension of the ḥudūd during the Occultation. The author concludes that the opinion of those who oppose implementing the ḥudūd during the Imam’s occultation, as well as the opinion of those who adopted a stance of suspension is stronger and more profound than those who advocate permission, regardless of their numerical strength.
