Abstract

This round-up reviews seven notable decisions of the English courts from 2024 (and an early entry from 2025). Rather than providing a traditional review of the facts, law and application of the law to the facts in each instance, the round-up has instead sought to draw out from each case a key point of law or practice considered by the authors to be of particular interest. Notwithstanding its status as one of the key cases of 2024, the Supreme Court’s decision in SkyKick has been left aside as this was recently covered in Darren Meale’s editorial (Darren Meale, After SkyKick at the UK Supreme Court, Will Bad Faith Now Be the New Battleground in Trade Mark Disputes?, Journal of Intellectual Property Law & Practice, 2025, jpaf008, https://doi.org/10.1093/jiplp/jpaf008) and in Giuseppe Sanseverino’s recent article (Giuseppe Sanseverino, Bad Faith in EU Trade Mark Law: The Impact of SkyKick Post-Brexit, Journal of Intellectual Property Law & Practice, 2025, jpaf004, https://doi.org/10.1093/jiplp/jpaf004).
