Abstract
The unwary purchaser came into being from the commercial explosion of the Gilded Age. This was the time when manufacturers and retailers deployed numerous techniques to secure a privileged position within the marketplace. Retailers and manufacturers both placed great emphasis on the significance of advertising and branding in stimulating positive purchaser response. The American government played a key role in defining the boundaries between legitimate and illegitimate products. One of the most powerful techniques used to distinguish the legitimate from the fraud was the enactment of new laws concerning trademarks and labeling.
