9 Environmental Mediation and the Scottish Planning Process

Abstract
This chapter provides an overview of environmental mediation in Scotland and the potential for mediation in the country's planning system. It first considers the political nature of environmental conflicts in Scotland and the role of environmental mediators in trying to resolve those conflicts before turning to a discussion of the environmental mediation process. It then outlines the basic structure of the Scottish planning system, with particular emphasis on the powers and responsibilities of local authorities, and both National Park authorities, under the Planning Acts. It also explains the importance of community engagement in planning, along with opportunities for mediation in development planning and development management. Finally, it looks at development management and enforcement and the government's emphasis on planning consent as a requirement for all forms of development.
