Article 15—SignatureThis Convention, done at Dublin on 30 May 2008, shall be open for signature at Oslo by all States on 3 December 2008 and thereafter at United Nations Headquarters in New York until its entry into force.
Overview of the Article
Article 15 lays down the conditions under which a State may sign the Convention on Cluster Munitions.2 The Convention was opened for signature in Oslo, Norway, on 3 December 2008. Similar to the 1997 Anti-Personnel Mine Ban Convention,3 any State that did not do so could sign the Convention on Cluster Munitions at the headquarters of the United Nations (UN) but only until the Convention entered into force (i.e. until 1 August 2010).4 Any State wishing to adhere to the Convention that did not sign it before that date must accede directly in accordance with Article 16.5
Contrary to what prevails in lay language, the signature of a treaty by a State is not always tantamount to the consent of that State to be bound by that treaty: on the basis of its sovereignty, a State may decide to sign a treaty and, afterwards, not to become party to it.
